Injustice for All: The Troy Davis Case

Most that come across this blog are already aware of the extreme injustice suffered by Troy Davis at the hands of the actors and agents of the State of Georgia. They intend to murder Mr. Davis at 7pm EST today and it doesn't look like anyone in a position to stop this murder will do so.

I have done all that I know how to do and the state pays no more attention to the many petitions sent through Amnesty International than it does to the lengthy list of government officials and celebrities (including former President Jimmy Carter) demanding a stay of execution for Troy Davis. There is much to be ironed out in this extremely questionable case, but they do not give a flying crap and want to murder Davis today; they cannot wait. The Georgia Board of Pardons and Paroles has no reason to care about innocence or public perception.

The case was based entirely on false testimony as 7 of the 9 alleged witnesses have recanted that testimony. Police coercion resulted in false statements and there was no physical evidence at all. Cops pushed harder than usual because the victim in the case was Mark MacPhail, an off-duty cop. I hope that these bad cops and weak idiots can live with themselves knowing that their actions resulted in the murder of an innocent man, but I doubt it and consider the potential domino effect. Their lives will change once Davis is executed.

The real killer of Mark MacPhail will walk at the very second that Troy Davis is murdered by the State of Georgia. His worries will be over.

EDIT @730PM EST: The US Supreme Court is reviewing a last minute plea for a stay and the execution has been delayed!

Edit @1220am: The US Supreme Court denied the appeal and the State of Georgia killed Troy Davis just after 11pm. So sad. They all suck.

The Southwest Companions Case Mystery

The Southwest Companions case has become the mystery of the year. Albuquerque PD created a huge splash with the news of the arrests of David Flory and Chris F Garcia, two professors caught in a website fiasco back in late June. There were numerous other arrests, though most were not announced to the news. Today the only one still charged in the case is Cara Garrett, charged with “bribing / intimidation / retaliation of witness,” as far as I can see. I'm not clear on how she intimidated a witness in a case that no longer exists.

I'm also not clear on why no one is questioning the Albuquerque PD on this case, but there are no news reports of anything related since the initial arrests broadcast to the world. I know it didn't all go away because of my Gutting the Albuquerque PD Case post. Was ist los?

Are the feds involved?

This is a distinct possibility. I have read that the Department of Justice is looking at Albuquerque PD on civil rights violations. I have also read that there is another case that touches this one that involves cocaine. However, it only touches the Southwest Companions case, and possibly only because the party saw escorts via the website. Nothing is clear so no names will be included herein.

It could also be that many involved in the case have turned informant. Who are the many? Certainly more than one of the escorts, but beyond that I do not know for sure. I was told that there was a vice cop involved in the investigation seeing escorts as a side fiasco, but the source wants to remain private. The information that I have also reveals that there are several escorts that turned informant, prior to the arrests of Flory and Garcia.

As it shows today, all charges against both Flory and Garcia have been nolle prossed and no one involved in any aspect of this case is talking. Scary stuff. We went from media circus to silence in a short period of time.

I am still puzzled after reading the article. For one thing, New Mexico law is sure different from Florida law in relation to filing time limits. Really the article (and the District Attorney) does not address the mystery at all and concludes by stating that there is much to sort through and they need to investigate and get the evidence in order.  Isn't that "investigating" and "evidence sorting" usually done prior to making the arrests? Hell, the Albuquerque P.D. blasted this huge story all over the news worldwide, ruining the reputations and careers of anyone involved.

Sorry "Alias Undercover," but mystery not at all solved. What the hell is going on in Albuquerque, New Mexico?

Okay, so there are a bunch of incompetent morons in charge of the justice system in Albuquerque (cops, prosecutors, judges). I suppose that I gathered that much after reading through the many news releases by various APD actors including the chief of police.

But who in the hell arrests someone on 40 counts of promoting prostitution without ALREADY having completed an investigation? They sure didn't need to arrest to get access to pertinent forensic info and the only additional info that should be a part of any investigation after the loudly announced arrest would be relating to additional arrests.

That is great that they've nolle prossed all counts. Where I stand, mainly due to the heavy publicity they secured throughout with worldwide news releases, is that it would be time to file a false arrest suit. They ruined lives and careers in the name of publicity and overzealous cops and now do not even bother to say a flippin' word? Sorry, but this is not how the system works, not even in New Mexico, and no matter how incompetent the participants may be.

Nope – there are many pieces of this puzzle still missing. Are a few of their own involved? Major corruption in Albuquerque? What happened to investigative reporting and who in the hell needs news organizations that simply repeat what talking heads state? Sorry, but the big mystery is far from solved.

Police Shootings and Life without Cops

I am sorry to read that the riots in Tottenham escalated and have spread to other areas of London. What began as a protest and a demand for correct information has now evolved into a free-for-all for thieves and anarchists bent on destroying the property of others and violently objecting to the social status they've been assigned in life. It is an inner anger with the system for many and just open season for others.

I have that anger with the system because of all that was done to me between 1994 and 2008. That is a long spread of time and the fact that few acknowledge what was done over such a length of time doesn't make it any better.

When arrested I was financially set for life. Today I live in poverty compared to most in this country and I am forever watched and unable to step beyond that condition. This really angers me for a few reasons, the main one being that I should be able to give my adult child a decent financial start in life, buy him a car etc... but thanks to a bunch of bad cops, a bad police agency, and a bad prosecutor, I cannot.

Beyond helping my son, I do not give a rat's ass about money and I will never buy a house in this country again, even if I one day manage to pull myself out of the hole they put me in. You see, they taught me that one never actually owns anything and it can all easily vanish overnight. A hard lesson, but one I will carry to the grave. My trust in the system is long gone.

Cops are another story entirely. My perspective on cops did not begin with the MBI. This should be obvious to anyone as if the bad experience started with the MBI, I may have trusted them, or at least one of them, and may have made a plea deal instead of going to trial. In fact I never trusted any of them, the liar prosecutor, or any of the escorts for that matter. I have always been guarded in who I trust, and for good reason.

I commented on a post on the Duchess of Hackney's blog. She's a nice lady and I like her, but I don't think she understands how serious I am when I state that I'd never trust a cop or call one for help. I have called cops a few times over the years, but only to document a situation and get a case number; not for help. I stated in the comment that I wouldn't call the police if my next door neighbor was a serial killer and I meant exactly that. She responded:

“...There is a reason we have a police force and I’m glad we do. You can’t tell me the cops in Florida don’t help people. If someone was breaking into your home while you were in there, who would you call?”

No Duchess, I cannot tell you that cops in Florida do not help people. I can tell you that the idea of helping people is a minimal part of the job description, say 1% at most. Some cops never help anyone and other cops help people often and make-up for some of the unhelpful cops. I can also tell you that if someone were breaking into my apartment, I wouldn't call the police. What would I do? Well, I am not a convicted felon and I can own a gun, but beyond that I will not state what I would do on this blog.

I wrote about a good cop, sort of, in The Good Cop. I don't hate or despise all cops and in past, a few of my best friends were cops. I had a long relationship with a cop. But I do not trust cops and I never will. I didn't trust cops long before my arrest on November 20, 2001. Now I will tell you why...

The only time I ever called the police for help was in Jackson County, Oklahoma. You might be curious what ever brought me to Oklahoma to begin with so I will give you the short version: My son's father had (he is now deceased) family in that area and within a few months of giving birth to my son we chose to move there and buy a house. Houses are cheap out there – they were back then and they still are now, but for good reasons.

I didn't want to raise my child in crime-ridden Miami – this was back in the mid to late 1980s and Miami was the land of cocaine cowboys. I told my son's father that we could stay in Miami, but neither of us had family there and I would never be leaving my child with anyone, therefore we could never go out together again, at least not to the clubs. Probably the main reason for this was the Country Walk case – we lived close to Country Walk subdivision. For those of you that are unaware it was a ritual abuse case involving the Fusters, a couple that watched children for many residents in the subdivision. Read about it on PBS Frontline.

So back to the only time I ever called police for help...

Having never been to Oklahoma, I was clueless how anything worked there. Going from Miami to Jackson County, OK was a culture shock for sure. My first surprise came when my son's father asked me to go pick-up some beer at a store down the road. I was in the middle of something (like unpacking) and asked him why didn't he go. He explained that he'd have to change clothes and didn't know where they were at the moment, but couldn't go in his OP shorts. I asked why not and he asked me if I had seen any male wearing shorts anywhere in the two weeks that we had been in the area. We had found a bargain house (or so we thought) in a small town (less than 400 people) called Duke and our new house was actually a mile outside of Duke. Anyway, it suddenly occurred to me that he was right – men didn't wear shorts in Jackson County. Hopefully the area has since changed.

What a weird fucking place this was, but I was still clueless as to how weird or the level or weirdness. (smile – yeh, I can smile now that I'm long out of there). We had been there for well over a year when the fights really started. It was everything, but mainly money. He was stuck working for the mayor of little Duke for really low wages and no health insurance or anything else. The guy was a rancher and my son's father had to do things like put up fencing, plow wheat and cotton, cut off bulls' nuts (yes, really), shoot bulls with steroids, and anything else done on a working ranch for that super low (under minimum) wage. There really was no other work around, and that rancher made sure of that.

After we had been in Duke for a year and a half it wore us down and we fought each other. The place just sucked. Nice house though – it had a large (2 to 3 car) garage, a huge party room above the garage where we placed a pool table, 3 bedrooms, a couple of bathrooms, a chicken coop, and it was on 5 acres. During our last major argument there, I stated that I wanted to go to my dad's in Florida. He stated that I wouldn't be bringing my son and if I tried, he would take him to Mexico and I'd never see him again. One day while he was at work I packed a few suitcases and moved to a dumpy little house in the nearby city of Altus, about 7 miles away.

At the time I was working on the AF base in Altus in the youth center, so I figured that I could survive without moving to my dad's in Florida and no major custody battle would ensue. I would just live with it until my son was older. In case any readers are wondering why I never returned to Europe, now you know – from the moment my son was born I was stuck in this country. My son didn't turn 18 until several years after my arrest.

So one day I went to drop my son off with his regular babysitter, an AF colonel's wife, (she was Russian) and she said that she could not watch him anymore because he didn't listen to her and would just go in the refrigerator and get a drink when he wanted. What? I recall calling her a stupid bitch and exiting. Now I had no babysitter. As timing would have it, my son's father called to say hello and was actually being normal, or at least sounded that way at the moment. He stated that his mother would love to watch our son until I found a more permanent arrangement.

Naïve as I was at the time, I dropped my son off at his grandmother's house. We had a skate night at the youth center that night and it was around 11pm when I arrived to pick my son up. I was greeted by his seriously intoxicated father – he had been drinking tequila all night. I was attempting to place my son in his car seat when his father grabbed him. It isn't as if I could have hung onto him. He struggled to get my son in the car seat in his truck while I ripped at his back – a physical fight ensued and ended with him throwing me to the ground, jumping in the truck, and driving off. I jumped in my car and chased him briefly, but his driving was erratic and he was actually driving into ditches.

Realizing that chasing a drunk driver intent on getting away with my child in the truck was not intelligent, I went home and dialed the Jackson County Sheriff's Office. About 20 minutes later, they called me back and stated that they found my son's father walking down the road carrying my son and the truck had run out of gas on the road to Duke. The cop told me that other cops were bringing them to the station and that I could come and pick-up my son. Relieved, I jumped in the car and arrived there in about 3 minutes.

On arrival, I was instructed to sit in a chair and told that they were on the way with my son. Well, about 20 minutes went by... this made no sense to me. I asked where my son was and a cop asked me, “Is that there his father?” I responded that yes, he was his father. The cop stated: “This here is a civil matter. We can't help you and you need to go to court.” I asked what about the fact that his father was driving drunk as a skunk, but that was immaterial. I got up and stated, “Thanks for wasting my time. I'll take care of it by myself.”

The next thing I knew I was being thrown to the floor by this cop and they were removing my shoelaces and telling me I was under arrest. “For what?” I asked. “Obstruction of justice” was the answer. I asked to make my telephone call and dialed my father. Dad asked me what the bond was and I turned and asked the deputy. He started laughing and stated, “That's a non-bondable offense. There is no bond.”

When I repeated the no bond statement to my dad, I admit to saying, “this hick cop says...”. The stupid cop ripped the phone-line from the wall. That was the last outside communication that I would have for several days. They snapped a Polaroid picture of me (that's how backwoods this place was) and took me to a cell, telling me I'd be going to prison and wouldn't see my son for a long time. I paced for two nights and three days with no sleep as I considered it possible that my son's father was already in Mexico with him. A nice woman gave me a pack of cigarettes, and I later repaid her a carton.

On day three a nice guard came and opened my cell door, telling me, “I don't know what is going on, but they are releasing you and you have to call your father right away.” I would later find out that a variety of people from the AF base, including the commander, attempted to rescue me. My boss and a couple of co-workers demanded they give me a bond, but were literally thrown out of the sheriff's office and told they'd be arrested if they returned.

The one that got through to these corrupt scumbag cops was my father. He finally got ahold of the Sheriff of Jackson County at home and informed him that he had exactly one hour to either release me on my own recognizance or on bond and if he did not hear from me within one hour, outside of that jail, that he would be on the next flight out of Orlando to Oklahoma City and taking it directly to the US Attorney.

So they released me and instructed me to dial my father immediately from the payphone across the street. I still had a problem though, so I wasn't exactly running out the door. I asked the deputy releasing me if they intended to lock-up my son's father when I went and took my son back from him as they did to me. The nice guard kept trying to shush me, whispering that something was weird and I just needed to get out of there for the moment.

What was weird? Well, recall that I stated my son's father worked for the mayor of Duke. When deputies found him walking down the road carrying my son he informed them he worked for R. B. Masters and they made a call to ole R.B. who needed his underpaid worker more than we knew.

That part of the story ended with an appalled judge – he just shook his head in disbelief at what these bad cops did to me and dismissed the case. His exact words were, “I do not even believe this!” The judges last name was Darby – bless his heart.

To give you an idea of what R.B. Masters was like, I will tell you that he owned the house we were buying and we did what they call a "contract for deed". Part of that contract was that he had to approve any transfer of the property. We had it half (over 50%) paid for and attempted to sell it and retrieve our money, but when a black couple came to look at the house and R.B. met us there, he pulled me aside and said, “It will be a cold day in hell before we have any watermelon pickers living in Duke.”

And yes, I did get my son back several days later, all by myself. (smile)

I think that about summarizes my thoughts on cops and my viewpoint of rural Oklahoma. So no Duchess, I would not call cops if someone was breaking-in – I would rather take my chances with the intruder.

Executions in Orlando and Riots in London

In January 2010, nine Orange County, Florida sheriff's deputies executed 27 year-old Torey Breedlove in a hail of bullets. Over 130 rounds were fired at the unarmed man because he attempted to drive away and didn't stop and exit his vehicle when ordered. Breedlove was allegedly a car thief. Within a year all deputies were cleared by the Florida Department of Law Enforcement (FDLE) and the shooting determined to be justified by the agency and a grand jury.

How in the hell can they justify executing an alleged car thief that was unarmed? The way it works here, the deputies probably received commendations. Read more about the execution of Torey Breedlove HERE.

Back in January of 2004, Orange County Deputy Richard Mankewich shot and murdered 26 year-old Marvin Williams when Williams took off running during a traffic stop. Mankewich chased the unarmed Williams through a populated neighborhood near downtown Orlando, firing repeatedly, and all because he fled during a traffic stop. Sure Marvin Williams had a record and his driver's license wasn't exactly in order, but is that a valid reason to execute the man? Read more about the murder of Marvin Williams HERE.

Mankewich is better known for his 1997 traffic stop of a Miami police major traveling on the turnpike through Central Florida. Campbell is black and the case had major racial overtones since there was no valid reason for the traffic stop to begin with. Before the stop was over, and Campbell was arrested on a list of false charges, I am sure that he considered it more than possible that the good old boy cops intended to kill him.

Deputy Mankewich was promoted not long after he shot and murdered Marvin Williams. He also has an extensive record of complaints and at the time he killed Williams, there were 27 complaints of excessive use of force. Our lousy former sheriff, Kevin Beary, never bothered to investigate any of the complaints against his prize deputy. My main questions would be were all of Mankewich's victims black? If not, then what percentage were? Mankewich is more recently known for his odd and false arrest of a black juvenile that was later tossed out by the state attorney's office – read about that in Government Accountability.

There have been many more murders committed by Florida deputies during traffic stops in the last decade than anyone would care to admit and far too many in Orange County. When I was researching for a civil suit against Sheriff Beary et al. back in 2003, I found a lengthy list of cases in federal court files. In one particular case, a 16 year-old was electrocuted with 19 jolts from taser guns by 7 “John Doe” deputies. The deputies were referred to as John Does in the suit because Sheriff Beary ditched the police reports and all paperwork and the mother and her attorney could not even get the names of the deputies that murdered this unarmed teen. A lousy federal judge dismissed the suit; the same lousy judge that dismissed my own, if I recall correctly.

State and federal files here are full of dismissed cases against former Sheriff Beary for abuse, excessive force, and murder committed by his unruly deputies, though the Torey Breedlove case occurred on current Sheriff Demings watch as many more have also. These people do whatever the hell they want to do to the citizens, and they get away with it. They literally get away with murder.

In other news, rioters burned stores and attacked police over the shooting death of a motorist in Tottenham, a socially disadvantaged area in north London. Hey – at least the people in this area react to bad cops and police abuse, as they should. The police are supposed to be working for the citizens, not killing them. I haven't seen any normal reactions here since the riots after the cops that beat Rodney King were acquitted in trial back in 1992. What happened here? Perhaps it is exactly what I have been saying: Somewhere between 65% and 75% of the population is drugged and with these mind-numbing psychotropic drugs, fighting back is not an option; they'd rather watch trash on television.

Am I condoning rioting and looting? I don't know and if there is a better solution, please do inform me on the specifics. Filing complaints results in nothing whatsoever here and the complaints are ignored and tossed in the garbage. Filing lawsuits does absolutely nothing either – bad judges that work in a corrupt system simply dismiss the lawsuits for the bad cops. Grand juries manage to find justification for cops executing unarmed motorists. Been there and done that. You see, that is why I wrote Memoirs – to keep the information out there. Serious police misconduct and abuse involved in my case, but few even care to read about it and many more buy my Blueprint books – thanks, but totally beside the point.

In the US, police are rarely held accountable for their actions so they abuse the general population at will. Why not, right? Cops decide that actions by other cops are justified, even when it amounts to murder. Judges and courts give cops and the state a pass regularly in Florida. The FL Department of Corrections regularly sanctions any abusive actions by its own guards. We have the fox guarding the henhouse here - it is totally absurd!

Federal prosecutors in New Orleans are different today. They went after bad cops that murdered and covered-up murder and the people answered: Five cops all found guilty and facing decades in prison where they belong. Kudos to federal prosecutors in New Orleans for pursuing these bad cops that execute citizens! So, any thoughts on how we can hold them accountable for police misconduct, abuse, and murder of citizens?

I was arguing on a message board yesterday – something I do often these days – and the topic was a 17 year-old that supposedly committed suicide in a Florida Department of Corrections (DOC) hospital facility. Demetrius Jordan was found hanging in a cell. His family believes that it was not suicide and that he was beaten to death and the hanging a part of the cover-up. This may indeed be the case, but this was his 4^thtrip to the hospital facility, they were about to send him back to the DOC facility, and maybe he saw no hope and couldn't fathom a return to a facility wherein he has been beaten and abused so frequently.

Was Jordan's abuse at the hands of corrections staff or just on their watch? Either way it reveals negligence on the part of the staff and only to different degrees. He was a 17 year-old, a child, that these state minions claim to be protecting in so many other ways. How in the hell can a healthy teen require hospitalization on four separate occasions in the course of just over a year and someone in authority does not question and investigate it? Tell me how, please, because I will never get it. No one else posting in this discussion even cared and several thought that it was good that Jordan was dead. The article is HERE. Florida's juvenile facilities are some of the worst in the country and now many are run by G4S, formerly known as Wackenhut. Allow your child to end-up in a Florida juvenile facility and that child may never make it out of there. If by chance your child makes it out alive, the damage sustained will last a lifetime. Get off the flippin' drugs people or get your heads out of the state's ass and start holding them accountable for their actions. 

Former Cop Frank Carter of Melbourne: Expounding on the Issues

Many have arrived at this blog recently by searching for Frank Carter's name and it is time to expound on the issues and hope that you understand why I consider Carter a bad cop, regardless of inept prosecutors, collusion, or corrupt judges.

Most bad cops are never prosecuted; look how long it took prosecutors in Cook County, Illinois to try Jon Burge for a lousy perjury charge when we all know that he ordered and participated in torturing suspects to obtain confessions. Of course most of those confessions were false, but the defendants still languished in prisons for years. The fact that the farce of a corrupt system cannot manage to prosecute Carter means little to me.

I find it far-fetched and implausible that Brevard County prosecutors couldn't find any complainants that were willing to testify. From what I know there have been hundreds of complaints against Frank Carter over the years, but of course time is an issue and I am not sure of the statute of limitations on official misconduct charges or falsifying official records or documents, so all cases are no longer valid. They ignored this train wreck for years.; probably 20 years altogether or close to it.

The main case that prosecutors used to arrest Carter was questionable. Getting down to the basics here, Frank Carter was accused of making illegal traffic stops and conducting illegal searches. There is no doubt whatsoever that he has done this hundreds, if not thousands, of times in his 20+ year career. To me he is the definition of “bad cop”. He is the same as the Hernando County deputies that did the traffic stop on my son and his friend a couple of weeks ago. He is the same as several Cocoa P.D. officers that have done worse than the Hernando County deputies did to my son in the past five years.

Ever since my son got a driver's license he has experienced illegal traffic stops and illegal searches of any vehicle he drove. We have it down to a system because it happens so frequently. For the most part it has always happened in Cocoa with Cocoa P.D. officers. It has not happened in Cocoa for a couple of years though, not since my visit to the Cocoa Police Department to speak to a supervisor and request records.

On my last trip to Cocoa P.D. (it was far from the first), I encountered an intelligent supervisor. I'm not sure if he was a sergeant or a Lt, but this is immaterial anyway. A nice man that had recently relocated from NY and was attempting to reform the department, and he sure managed to smooth everything over with me. When I enter a police department under such circumstances I am angry, no doubt, but I am also intelligent enough to know that sarcasm with a smirk is the only tool available to me to get my point across.

In this particular traffic stop my son and a friend were pulled-over for no reason and held for 45 solid minutes while Cocoa P.D. waited on a dog to arrive – that dog was busy in Melbourne, as has been the case in past. That dog was probably busy with one of Frank Carter's illegal traffic stops. The officers were told clearly twice that they had no permission to search so instead they waited on a dog. Neat, except that holding a driver and passenger for 45 minutes is also illegal. Of course there was no reason to call a dog and of course the dog didn't find anything.

I was having a discussion with someone the other day about possible reasons that cops target my son. His last name is different so they do not know that he is my son when the siren and lights go on, so it isn't the usual hatred of me. For years it was stickers on the vehicles and the hour of night that he was driving, in my opinion. He has always been into music and had 10+ and closer to 20+ heavy metal band stickers on any car he has driven. He also worked for Papa John's from age 17 forward – first as an insider, then as a driver, and later as a manager. He has always had the latest shift and often didn't get out of work until 2am or 3am, so that is why he would be going to Walmart or driving down the road at that hour. Not everyone is a day person, as those late shift cops should know.

The recent Hernando County stop was different in that my son was in a rental car that was close to brand new, so no stickers. It also happened at 1am on a Saturday night and I do not consider that late.


Back to Frank Carter

The main case that prosecutors used to arrest him was of one Laura Cabrera. Of course I do not know Laura, but if you look at her record she has been charged with drug and drug-related counts more than once. I believe that she even pleaded to a count once. This woman has had a lengthy list of traffic stops, many probably care of Frank Carter. Carter probably found drugs when he illegally searched when he had no right by law to stop her to begin with. The law is the law and if officers like Frank Carter are not going to obey it, why should we expect Laura Cabrera to?

I didn't mention Cabrera's case in my previous posts as I preferred the case of Dienecia Johnson. She never pled to any drug charge and has had too long of a list of traffic stops for no reason. My previous discussion of her traffic stops is clear on why Carter could not have had reason to pull her over to begin with: She was charged with not having her driver's license or registration to show too many times. How in the hell could Frank Carter know that she didn't have either available when he pulled her over? He couldn't and in several cases she was not charged with anything else.

The situation with my son has been similar several times. He was pulled over for no reason whatsoever and a couple of times the offending cop actually created a traffic ticket for an offense that didn't exist to cover his illegal stop and illegal search. In one case the created ticket was for “running a red light” and my son took photos of the intersection, obtained the records of the pull-over, and argued it in court. The judge found him not guilty. I won't bother to explain how turning right on red without stopping at that intersection was absolutely legal, except to say that it had to do with the lane merging and no stop bar. During that stop my son was subjected to an angry Marine Drill Sergeant cop yelling at the top of his lungs throughout (30 solid minutes), throwing my son against the car to search him, and an absolutely illegal search of the vehicle – no permission and no reason. The dog was busy in Melbourne – again probably at one of Carter's illegal stop and search escapades

There are far too many of these bad cops on the road. Something must be done to stop this in our society. If supervisors don't give a fuck, then it is time to get rid of the supervisors with the bad boy cops.

If the Melbourne P.D. takes Frank Carter back they are in collusion with him and advocate criminal behavior. It is easy to look at his traffic stops and know that he doesn't give a rat's ass about following the law. This guy considers himself a superior being that makes his own judgment calls and totally disregards law.

I have so many additional examples of bad cops detaining my son, including two that involve pizza delivery, that this post could go on and on for pages. Perhaps I will bore you with more later, but hopefully I have made my point concerning Frank Carter.

A cop doesn't have to be dealing drugs or raping women to be a bad cop.

All Charges Dropped in Melbourne Bad Cop Case

Police abuse and misconduct is clearly acceptable in Florida. They have proved this time and time again, but many had high hopes that Frank Carter would finally pay his dues for all of his deeds against the motorists and residents in the predominantly Black University Boulevard area of Melbourne, Florida. Folks, it ain't happening and this guy will likely be back in a patrol car with $500K + care of Florida taxpayers in short time.

To Dienecia Johnson: Do yourself a major favor and move out of the Melbourne area. It is highly unlikely that this guy will let this situation go and you could be in real danger. They will probably be handing him his gun back soon. I have encountered too many cops just like him in Florida and they don't let anything go.

I am wondering if Frank Carter has a friend in the State Attorney's Office that cooked-up this entire bullshit scheme to put plenty of taxpayer money in Carter's pockets. Think about it – they wouldn't have made such an arrest of a high profile career cop with no evidence, but then suddenly some evidence was no longer evidence at all. Now there is no evidence whatsoever, they claim, and charges are dropped. Carter can indeed file a false arrest suit and most likely will – he should as they caused him extreme distress and cost him lots of money. Wouldn't you? Because the charges have been dropped he will collect on a false arrest suit.

A person acquitted by jury, such as me, has no such simple ordeal. They claim the jury was stupid until the cows come home.

I know exactly what Frank Carter was and will be once again, but with his behavior sanctioned by the State of Florida this time around.

Bad Cops an Epidemic in the US

A police officer has more power than anyone, including the President of the United States (POTUS). This is a statement that I first read in Marshall Frank's book, Criminal Injustice in America: Essays by a Career Cop. Marshall Frank spent 30 years in law enforcement in Miami and is a retired captain from the Metro-Dade Police Department. He would know. From the time I entered this country to date I have encountered so many bad cops that I considered this a U.S. epidemic. Sure, I know that there are some good cops out there; I just drew the justice card and rarely meet any. We all draw different cards in life and mine all relate to justice, or rather injustice.

Most people go through life and never encounter bad cops. This doesn't mean that I did anything wrong and they did everything correct; it means that they didn't draw the justice card in life. Most people remain clueless as to the inner workings of the criminal justice system in the US, though I am not so sure that clueless is a preferred state of mind so I'm happy that I am enlightened regardless of all the problems involved.

I watched a CNN special a few nights ago: Race and Rage: Rodney King 20 Years Later

Rodney King stated that he did forgive the officers that beat him on that unforgettable night in Los Angeles. You may be thinking, why can't you forgive if King can Vicky? Well, I thought about that myself when he made the statement; however, the huge difference is that King's bad cops paid – two officers were convicted on civil rights violations and then King received $million + for his suffering. No one would even let my bad cops get to the point of a trial. None of the bad cops that I have encountered in the last 25 years have paid, yet. So, my state of mind is still that of an angry victim.

I do not know if there is a God and a Heaven and a Hell. I often have doubts and consider believers to be no different than idol worshipers. We all need a crutch in life, but that has never been my crutch. For the first time in many years I prayed to this unknown God the other night. I did this while my son and his friend were in the clutches of the scary and dangerous bad cops referred to in my last post. I do not know if prayer helped or not, but they went from intent to seize the vehicle and arrest my son and his friend on some unknown charges to a short don't come back here again speech. Maybe there is a God after all. Maybe deputy bad-ass #1 had second thoughts for another reason.

A quick search in the Inmate Locator on the Federal Bureau of Prisons (BOP) website reveals that former Chicago police commander Jon Burge is still not serving his sentence. If you are not familiar with the deranged Chicago police commander that ordered and/or participated in torturing over 200 African American men between 1972 and 1991 to force confessions, please read Who is Jon Burge?

Let's not pretend that the charges that Burge was tried on and convicted of reflected his actual crimes against humanity. Burge is the poster child for bad cops.

What ever happened to Lake County Florida Sheriff's Office Detective Ralph D. Fiorenza? The information that I located says that he is retired. He receives a pension for his years of service, no matter that those years included falsifying reports and other criminal acts committed against Mario J. Bassignani and uncountable others, no doubt. This piece of shit, like so many others including Jon Burge, is actually allowed to retire with a pension. Not familiar with Mario Bassignani's story? Mario was an engineer at Kennedy Space Center until bad-ass detective Fiorenza entered his life. Mario blew his brains out on the courthouse steps in Lake County, Florida on February 6, 2001. May Mario Bassignani rest in peace and know that if there is a Hell, well, Fiorenza will be going there when he finally croaks.

Bad cops are rarely held accountable for their criminal acts in the US, so is it no wonder that cops like Frank Carter, former Melbourne P.D. officer, and the asshat Deputy Genovese of the Hernando County Sheriff's Office that my son and his friend encountered over the weekend run rampant as they do? No wonder at all as most (defined as more than 50%) of Americans love to see people in cages and suffering.

We live in a country in which most of the population loves to see others suffer, whether guilty or not. Toss that bullshit line innocent until proven guilty right out your proverbial window, because they do not give a rat's ass and consider anyone a cop approaches to question or anyone arrested guilty. We don't need trials here; not in the US. Cops decide innocence or guilt and cops get away with anything and everything in this corrupt nation.

But eventually all bad cops pay for their dirty deeds and crimes against the people.

Overzealous Scary Cops in Hernando County Florida

Last night my son and a friend had a frightening encounter with several (4) Hernando County Sheriff's Office deputies out in the rural area referred to as Ridge Manor, Florida. Either three or four patrol cars arrived at the scene with a total of 4 deputies. My son was driving a Toyota Prius and had the vehicle papers and his valid driver's license to hand the deputy and was puzzled as to the reason for the stop as he is ever so careful not to commit any sort of traffic infraction whatsoever.

Alex has learned to just stay a smart distance from cops and has been taught to understand that a police officer is more powerful than the POTUS. One must fear that a cop could plant drugs or shoot them dead as the result of a simple traffic stop in Florida. The only time I shake is if I am being pulled-over by a cop as there is no telling what will happen next. No one wants to die at the hands of a whacko cop that later claims to have seen a weapon and trust me, it happens too often in Florida. And we aren't even Black. I fear for the Black motorist in this lousy state – refer to my posts on former officer Frank Carter of the Melbourne Police Department.

Alex was driving at a speed of 52 mph and the speed limit before the stop was 60 mph, so he knew the pull-over had nothing to do with speeding. The car is almost new and sure didn't have any light out or faulty equipment issue. Knowing that he had done nothing illegal or even incorrect, he had his friend dial me the minute that he heard the siren and had the brights in his face as the cop turned around to come after him. The second that police vehicle #1 got behind my son, vehicle #2 and vehicle #3 (and possibly a #4) appeared from nowhere and were also behind him with flashing lights on.

Alex pulled to the grassy area on the side of the road right next to the intersection of Croom Rital Rd. and Kettering Rd. in Hernando County, Florida. I was on the phone with his friend at that point. This is exactly what happened next and Deputy #3 and Deputy #4 remained in the background throughout never saying anything to them. [my thoughts and Alex's descriptions are in brackets]:


Unknown Deputy #1: License and registration

Alex: Yes sir. May I ask why we were pulled over?

Deputy #1: We received a complaint of objects being thrown out this window at the vehicle behind you.

Alex: I don't know what you're talking about. We didn't throw anything.

Deputy #1: I'm going to be real with you. I'm a dickhead who doesn't give a fuck about anything. I don't have time for fucking games. If I find out one of you is lying I'm going to seize this vehicle and everything in it and you're both going to jail. The vehicle behind you has a witness, the vehicle behind them, that is willing to write statements. [took driver's license and car paperwork and walked back to his vehicle] [I heard the entire conversation - the deputy was loud, but not screaming as some do]

[within a couple (3) minutes]

Deputy #1: Passenger out of the vehicle. [brought my son's friend to side of deputy's car]. [I heard this].

Friend described: [The deputy asked what happened here and friend told him the story]

What really happened: We were behind a car driving about 15 mph under the speed limit. There was no lane to pass him, but two other vehicles went around both of us. I waited until there was a second lane to pass and went around the slow driver. The driver attempted to run me off the road by speeding-up as soon as he saw I was trying to pass him. I passed him anyway by speeding-up. He was right on my rear and turned on his brights and this went on for about five minutes. He pulled-off and about 10 minutes later I am being pulled-over, but have no idea why.

The friend thought the cop asked him to empty out his pockets and was starting to do this when 3 deputies went for their weapons and 1 grabbed him by the shoulder and pushed him against the car. The deputy told him to place his hands on the car and then patted him down, placing his hands in friend's pockets, and searched him. Scared him to death.

Deputy #1: Mr. -------

Alex [got out of car and walked towards deputy #1]

Deputy #2: GET OFF THE PHONE! [I heard this]

Alex: It's my mother. What...

Deputy #2: GET OFF THE PHONE NOW! You're 18. Hang it up.[I heard this]

[I had instructed my son to ask the deputy's name and where/what police department he was with as my son had no idea where they were specifically at that time]

Alex: Yes sir. [he hung-up on me]

Deputy #1: Your buddy over here admitted everything so you want to be smart as well and go ahead and confess to what happened.

Alex: [repeated story of what actually happened]

Deputy #1: Do you have any weapons, guns, drugs, hand grenades [?] paraphernalia?

Alex: No sir.

Deputy #1: PUT YOUR HANDS ON THE CAR! [deputy starts going through Alex's pockets and searching him and looked through his wallet]

Deputy #1: Do you have any drugs, weapons, guns, paraphernalia, hand grenades, or dead bodies [?] in the vehicle? So then I have permission to search, right? [exact quote]

Alex: Yes sir.

Deputy #1: Turn around and face my partner. [Alex no longer had any visual of vehicle] [deputy searched for about 4 minutes]

Deputy #2: [starts asking both Alex and friend questions]. [He pointed at a vehicle and asked both at the same time if they recognized it and both responded “no it doesn't look familiar”.

Deputy #2: What are you doing way out here?

Alex: Visiting a friend.

Deputy #1: [pulls out posters and flyers from back seat]

Deputy #2: Why do you have all of those?

Alex: I do some promoting for Club Firestone.

Deputy #1: [walks to his vehicle] You might want to stay in Merritt Island boys and don't come around here again. We are a bunch of fucking pricks who don't give a shit and will cause you some fucking problems. [Deputy threw Alex's driver's license in the grass]

Alex: [we got back in our vehicle and noted Deputy #1 walked to the vehicle that we couldn't identify].

So what in the hell is going on in Hernando County? Apparently they sure do not want anyone that doesn't live there entering the area. My son has had many traffic stops for no reason whatsoever, but none as scary as this one because they really do not know the area at all and even though he has met cops that were screaming like Marines throughout the encounter, they do not normally threaten to seize a vehicle and take the driver and passenger to jail – this is the unique issue here. Of course the search demand was because they expected to find drugs.

I have since dialed the non-emergency number for the Hernando County Sheriff's Office and the operator was helpful. She stated that the deputy that made the stop (deputy #1) is Deputy Genovese. She was unable to locate any information for the other deputies or did not offer the information if she did.


To Deputy Genovese with the Hernando County Sheriff's Office:

I have taught my son to always fear cops as truly you are more powerful than the POTUS and capable of absolutely anything. You prove my point. I also taught him to never give a police officer permission to search, no matter that there is nothing illegal or even incorrect in the vehicle. However, when I heard your threat of seizing the vehicle and taking them both to jail, I knew (from your own words) that you are indeed a total prick capable of anything and since we all knew there was nothing illegal in the vehicle, I told my son to agree to any search prior to him hanging-up the phone.

This is the United States and no one should be coerced into a search and threatened as you did to these two late last night (1am). Do you think you own Hernando County? Do you believe that you actually have the authority to tell any motorist to never return to Hernando County? Guess what prick – you don't own shit and I'll drive through Hernando County any fucking time I want to.

My son really feared that you would plant something in the vehicle (drugs). Why did you instruct him to turn around and face your partner so that the vehicle was no longer in his line of vision? That is something I have never run into and it shouldn't be considered legal.


I will offer a short scenario of the events to follow if you had taken them to jail last night:

Of course I would attempt to bond them out immediately, but not knowing anything about how it all works in Hernando County, well, I may or may not have been successful. No matter what, I would have them out on Monday before the morning was over. Each of them would then be filing a false arrest suit against you, the unknown deputies that joined you, and the Sheriff of Hernando County.

This is not a lawsuit worthy encounter and this is the last you'll hear of us Deputy Genovese, but someone needs to take some of your power away. Cops like you are why I have instilled it in my son's mind that he should never trust any cop anywhere for any reason. You really are a fucking prick – you said it.

Most Bizarre Racketeering Case Ever

In my last post – Looking Forward in 2011 – I requested than anyone ever hearing of a more malicious racketeering / RICO prosecution with so little evidence that there was no search warrant or court order to wiretap involved to state the case and the court. I invited you to prove me incorrect in my statement that there is no case as ridiculous as the one I endured, and a relative of Philip Furtney came through.

He made no mention of my challenge, but the topic of the email was Philip Leroy Furtney of Ontario from The Bingo Racketeering Case. This man endured more than anyone in any of the Metropolitan Bureau of Investigation's (MBI) absurd prosecutions abusing the racketeering statutes. Of course it is an MBI case in Orlando!

Also the FDLE has dropped all of the original charges yet added another. Florida Today paints a different picture.
Then why is there only one charge and not the original 8 or so? False information by the chief given to the FDLE. Also did you see who just retired early? The city manager.

Why would the arrest of Carter inspire so these two to retire?
I'll give you one clue, retirement benefits. They both could be subject to no retirement benefits.
What is Carter's sole charge standing? Giving someone a ticket for a poorly lit license plate. Florida read that a police offer must be able to read it from 50 feet.

Libel law in the UK is different from libel laws in the US. You left out one major point - truth is an absolute defense in a libel suit. If this were not the case I probably would have been sued for "Memoirs of an Accused Madam," but it is the case.

And here we are again, though this “anonymous” is not the same person as the last “anonymous” as is obvious by the post content; either that or he was drunk when he responded earlier. Once again the victim, Dienecia Johnson, is the one being attacked. Isn't it always that way when a bad cop is seeking some absurd defense for his actions?

First let's again address Dienecia Johnson's arrest record, specifically the statement that, “ She was arrested for selling both cocaine and marijuana. That is fact, not fiction.”

No shit Sherlock. As I stated in the blog post that you responded to, the case was DROPPED by PROSECUTORS. Furthermore, the case had to be incredible – she was released on her own recognizance. Even the judge knew it was bullshit. So Ms. Johnson experienced a false arrest – this is a point against Carter, and you're not doing a great job at defense buddy.

In so far as the rest of that list of crap charges goes, I am well aware of how bad cops work. When they have no real reason for a traffic stop, they simply create one. How in the hell could anyone know she didn't have her driver's license in her wallet before pulling her over? There was no other charge in several of the listed cases making it clear that she was being harassed.

In a few of the cases there was the usual bullshit charge: obscured tag; sign or covering on windshield; and driving vehicle in unsafe condition. Obscured tag my ass – someone needs to get some glasses if he cannot see a tag with one of the two tag lights out.

My son was pulled over for the same crap by a whacko overzealous Cocoa P.D. officer several years ago. The jerk then used this to write a ticket for “running a red light” and held my son for over 30 minutes while waiting on the dogs – they were busy in Melbourne. Needless to say my son took the red light ticket to court and was found “not guilty” because right on red at that particular intersection was absolutely normal. Hint – he took photos of the intersection to court. As if any of this would give him probable cause for a vehicle search! (lucky for whacko cop the dogs were busy in Melbourne)

Obviously you are a cop, and perhaps you're Frank Carter – I have no idea – but if you do not have anything better to do than harass motorists in your sector, then Melbourne P.D. needs to toss your ass as well.

I do not pretend to know anything about videos given to Florida Today. I do know that Frank Carter is an overzealous whack cop that harassed Black motorists in his sector for far too many years. People in that area were petrified of him. I'm not in that area or I would have seen his bad cop ass in court long before.

You have the audacity to bring-up a drug charge that was dropped by prosecutors a while back? Denecia Johnson should be filing suit for false arrest. All of that bullshit traffic crap is exactly that – do not pretend she ever harmed anyone, had an accident, or actually did anything whatsoever wrong. Your list merely shows the many times that the woman has been a Carter victim.

In so far as libel goes – truth is an absolute defense in a libel suit. If you (or Carter) believes differently, then file away. I am not your typical victim and I will see your bad ass in court.

A Discussion about Fired Melbourne Cop Frank Carter

This is more a response to an "Anonymous" poster on the Melbourne Cop Frank Carter Fired article than anything else. It is time to clear the air as this party has chosen to attack the victim in the current case, Dienecia Johnson. The party then returned to post a lengthy statement that ended with his or her perception of me and my own case and a warning concerning slanderous statements.

Dienecia Johnson has a checkered past including possession of cocaine and pot. Her records indicate she never has insurance or proof and doesn't carry her DL. Her mouth is what got her into trouble and a known drug dealer was seen running from her car. Florida statues allows a ticket to be written for each window with illegal tint. All charges were dropped but now a new charge has been brought up on Carter. The funny thing is Melbourne PD has lost the copy of the ticket Frank filed, now this is the sole charge they have him on. Did you know that the other charges that were filed and investigated by the FDLE were found to be valid and that the FDLE was given false information by the MPD and chief Carey? You didn't, instead you post your lies and slanted truths there by slandering Frank Carter.

Q) How much has the city spent on legal fees trying to get a charge to stick?

You were prosecuted on racketeering and RICO conspiracy charges yet subsequently acquitted in 2003. You owned escort services for a decade in conservative Orlando, Florida and wrote a book about running an escort service "The Complete Blueprint for an Escort Service." Sounds like a how to on dodging legal issues concerning prostitution. So you were lucky, really lucky.

I guess what I really have a problem with is you claiming only you are a victim of bad police work and cops can't have the same thing happen to them. It did and his name is Frank Carter. Now I'll go start my I love Frank Carter blog :D.

BTW you need to change all of your claims to "alleged." Slander charges can be expensive to fight and nobody needs trouble like that.

First I must address Dienecia Johnson since she is the subject of the first post:


The poster has the audacity to attack Frank Carter's victim in the current filing, and isn't it always that way? She is victimized by Carter and now the subject of attack with lies and deception. I took a close look at all of Dienecia Johnson's cases in the Brevard County Clerk of Court online. If I had been able today, I would have gone to Viera and viewed the actual file in the cocaine charge referenced by the poster, but my schedule is rather full this week and I dislike trips to any clerk's office as I always leave angry.


The only drug case that Dienecia Johnson has ever been arrested in is Case # 05-2006-CF-028296. It doesn't say which particular officer victimized Ms. Johnson in this case; however, the case was DROPPED by prosecutors. Perhaps a bad traffic stop and illegal search or was the charge created from thin air to begin with?

Ms. Johnson's first ever charge was a traffic charge of "No Driver's License" in 2005. In 2006 she was charged with two traffic infractions in one case: "Driving vehicle in unsafe condition" and "Failure to furnish proof of insurance". In another 2006 case she was charged with "Driver's license not carried and exhibited" and it was DISMISSED. In yet another 2006 case this poor woman was charged with "Driver's license not carried and exhibited" (DISMISSED) and "Operating a motor vehicle with unlawful sound making device," whatever the hell that means.


As we go into 2007, Dienecia Johnson was charged again with "Driver's license not carried and exhibited," which was again DISMISSED. Another traffic stop in 2007 resulted in charges of "Improper Passing" and "Failure to furnish proof of insurance." "Improper passing" is an often used charge when an officer wants to pull someone over, but has no actual reason.


Looking at 2008, Ms. Johnson was pulled over and given a ticket for "Obscured tag" – now that is a real stretch and I'd bet that Frank Carter got the dogs there, but they smelled nothing, nada – another bullshit charge. In August of 2009, Ms. Johnson was stopped and given a ticket for "Safety belt violation passenger." The next 2009 case is the case in which Carter wrote a ticket for each window. It is case # 05-2009-TR-003227. In this case he also wrote tickets for "Safety belt violation operator" and "Driving vehicle in unsafe condition," and all charges were DISMISSED.


Apparently one of Frank Carter's pals with Melbourne Police Department (MPD) intends to make Dienecia Johnson pay dearly – in an October 2010 case with yet another traffic stop she is charged with "Driving with license suspended revoked cancelled without knowledge" and "Failure to furnish proof of insurance," which was DISMISSED. So they managed to suspend this woman's driver's license without her knowledge – send them to the fucking police hall of fame.


Dienecia Johnson needs to get the hell out of Melbourne, Florida AND THEN start filing civil suits. She has been abused for years according to what I am viewing. Does the Melbourne P.D. have little more to do then to harass motorists? How in the hell do they claim to know Ms. Johnson's license and/or insurance paperwork isn't in hand when they illegally pull her over? She is most certainly a victim of profiling. May the civil suits fly Dienecia!


Now as to this poster's accusation that I lied when I stated that I have met victims of Frank Carter – Bullshit! I have met a total of 7 Carter victims – 5 are Black and 2 are Puerto Rican. In 2007 I rented a house in Cocoa Village from the Puerto Rican couple. They lived a couple of blocks off University Blvd (Frank Carter's sector) and also owned a couple of rental properties in Cocoa, and boy they had stories to tell about encounters with Carter. Each has records similar to Dienecia Johnson's, thanks to bad boy Carter. If "Anonymous" is an intelligent cop he or she will know how to find the couple's names and will know I ain't joking.


The five Black Americans that I met and spoke with all lived in Frank Carter's sector, and one worked at a neighborhood store as well. Every one of the five were absolutely and totally petrified of Carter; well they're not anymore thanks to Dienecia Johnson. These are the citizens that lived in Carter's sector. Why should any one of them need to be petrified of Carter? Every one of them considered the bad cop's actions to be racially motivated. Obviously I cannot offer any names – these people are the victims too. I also had a lengthy discussion with someone at an upper level with Melbourne PD, but the party must remain nameless.


Just because someone wants a speedy trial doesn't mean that the party is innocent. It is a defense tactic and little more. I find the statement that the MPD and Chief Carey gave the Florida Department of Law Enforcement (FDLE) false information to be dubious at best. Says who? Carter? No doubt.


A Florida Today article written by Kaustuv Basu and published on November 23, 2010, explains the refiling situation much differently than our "Anonymous" poster and I will go with the newspaper's version. The article is Officer Carter case re-filed.


Our poster is wrong on an additional assertion: Carter isn't being prosecuted because they're afraid he will receive a civil payout (fat fucking chance); he is being prosecuted because the Dienecia Johnson mess is the straw that broke the camel's back. Carter has hundreds of complaints against him from his years in the University Blvd. sector. It was about damned time someone did something to get this power freak out of his patrol car. Enough is enough.



And now we get to me and your assertions regarding my case…


Yes, I state that everywhere – I was prosecuted on "racketeering" and "conspiracy to commit racketeering (RICO)" by Florida's Office of the Statewide Prosecutor. I was also acquitted by jury verdict on both counts.


"Anonymous" has the book thing a bit mixed-up though: I wrote and published Memoirs of an Accused Madam: The War on Adult Business in Orlando in April of 2009, but sales were dismal. I then wrote Blueprint for an Escort Service in a few weeks and published it in July 2009. I followed this by writing and publishing Blueprint for an Escort Service 2: Beyond the Original Blueprint in February of 2010, and later combined both books and added updates in The Complete Blueprint for an Escort Service in May of 2010. By July of 2010, I finished and published the Second Edition of Memoirs, which has updates and is edited.


The Memoirs books are my story of all that they did to me, and I sure as hell wasn't "a victim of bad police work." I was a victim of BAD COPS, but you'd have to read the book to get that and I state on the first page that it is not recommended reading for cops – just look at a sample in Google Books and you could view that free.


The Blueprint books are exactly as described in Google Books and on Amazon, and not as "Anonymous" describes them. They also sell decently. I hereby offer Carter a free copy – it looks like he may need it. (smile) Frank Carter might consider writing a book and titling it "Surviving an Illegal Traffic Stop," or wait – it would sell better if Dienecia Johnson wrote it.


In so far as the poster's statement that my posts are slanderous – he clearly has no clue about law in this respect either. The correct term would be libelous but I haven't stated anything that could possibly invite a libel suit. Back to law school with you "Anonymous".

I do give Frank Carter the benefit of doubt in this post and the last post concerning his case. Most consider Carter's actions to be racially motivated. I think he would have treated the citizens like he has regardless of color or ethnicity. I think he is just another bad cop. Even if he is acquitted by a jury it doesn't erase what I know to be fact, and it also doesn't net him the civil suit jackpot - as I will attest.



I do thank "Anonymous" for being civil in the second comment and not attacking Ms. Johnson again.

More on GPS Tracking Without Warrant

I still want to know which state and/or federal agency used illegal GPS tracking during my criminal case, and I want to know more than ever now. According to the information that I heard today the Metropolitan Bureau of Investigation (MBI) was far from alone. So who actually planted the device on my vehicle the day after my arrest after I bonded out of jail while I was shopping at Publix? Which agencies utilized information illegally obtained from the device?

So far it looks like the MBI was working with the DEA and the FBI. This isn't unusual for the agency – I've stated before that I felt the hard hands of the feds involved in my case with the helicopter chase on I-95 in South Florida and all of the strange occurrences I experienced before I made it to trial. I last discussed this in GPS Tracking by State and Federal Agencies.

I'm not willing to let it go. I have filed FOIA (Freedom of Information Act) demands with various federal agencies for information, but have gotten absolutely nowhere. Today I received some additional information and now know positively that the feds were involved. How is it possible that I receive lies in response to FOIA demands? What the hell kind of a country is this? Law requires that they respond honestly to FOIA requests. Was this a covert operation in which nothing was recorded on paper or are they all liars? What did they think I did to deserve such a covert op if this was the case? I have said it before and I'll say it again: This case had little to do with my escort business operating in any illegal manner or breaking any laws.

Within a few days after my arrest I made sure that I wasn't followed – trust me when I say that I know how – and went to see a very old friend; someone I had known for a decade. That friend had nothing whatsoever to do with the escort business. Really I went to see him to stop him from coming to my house as I didn't want him to have any problems because of my problems. When I returned two weeks later – again positive that I wasn't followed – there were several men there working in the yard, or so I thought at the time, and one stated that the people living there had moved out and asked me who I was. I left without answering.

From what I heard today, the men working in the yard were actually digging-up the yard and they were feds. My friend had returned to his native country after my first visit, so he wasn't there to deal with the feds, thank God. The feds had no warrant from what I was told, but my friends rented the house so they might have received permission to dig-up the yard from the homeowner. They tried to get in the house and met with resistance and then everyone moved out shortly thereafter.

Now this story sounds too familiar to me, probably because it is a part of the Memoirs account of various things done to me following my arrest. Yes, they actually sent fake cable company people to my house that stated a need to dig-up my backyard and the prosecutor in the case screamed allegations in a court hearing that I "had trash bags full of cash buried in my backyard". I still have the CD recording of the hearing, so let's not bother to pretend it never happened, okay? In that court hearing I actually offered to let them dig-up the backyard, providing that they agreed to leave it as they found it, and no warrant was necessary. My offer was scoffed at, most likely because they'd already been digging in the yard and knew their allegations were false when stated.

Of course there were no "trash bags full of cash" but they actually got my co-defendant, Rocky, to state this same allegation in his original deposition made to get out of the Orange County jail. Rocky went from $900K bond to "no bond" (as in not bondable for any amount of money) to a $20K bond once he did his 4 hour deposition in the Office of the Statewide Prosecutor (OSP).

So now I find out that they went digging in my friend's yard as well less than two weeks after my arrest. This is the case that will never die, at least not until I receive truthful answers from the State of Florida and the feds. I ain't goin' away until I'm dead. I do not give a flying fuck who is offended or what I'm threatened with, and you could take that to the bank.

GPS Tracking by State and Federal Agencies

There was a case decided in U.S. Court of Appeals in the Ninth Circuit recently that allows law enforcement to place a GPS tracking device on a vehicle without regard for the Fourth Amendment or need to obtain a warrant based on probable cause. It doesn't even matter if they sneak on your property to place the GPS device on the vehicle. There is nothing new about this and it is something that law enforcement agencies across the country have done since Patriot Act was passed, but now it is legal whereas it required a warrant prior to the court ruling. Agents from somewhere placed a GPS tracking device on my vehicle the day after my arrest. I had bonded out of jail and had no choice but to go to the grocery store as Thanksgiving was two days away. They had me followed for the hour and a half that I shopped. I knew I was being watched and followed, but was clueless as to why at the time. I actually thought it had to do with how I paid for my purchase, so I used a credit card instead of cash. The stalking in the store was all too obvious as I was in there for so long with my teenage son's shopping list.

It was a couple of weeks later when I realized why I was followed that day. My house had a double-car garage and the door was down 95% of the time. My windows all had sheers and heavy drapes that were usually closed. My yard had a high privacy fence. They had no way of placing the device on my vehicle because they couldn't tell if anyone was home or not.

I am the champion at losing anyone in traffic or out of traffic. I learned to drive as a teenager in Germany, and I sure can drive if I want or need to. When I took the driving test in Germany it was 300 multiple choice questions and a serious driving test, and it required real study and practice. The test in Florida is 25 stupid multiple choice questions that anyone with half a brain could pass without looking at the book. In my younger years I also raced on occasion, and usually won. So trust me – I know how to drive.

The realization that they'd placed a GPS tracking device on my vehicle hit me when I noted that they kept showing-up (undercover, but still them) in places that I was when I positively knew that I had not been followed. It also occurred to me why they placed the tracking device on my car at about that same point in time: Agents broke into my home while other agents were sitting next to me in restaurants or lurking around corners when I was inside a friend's house. To this day I have no real idea what they were looking for when they broke into my home, but if I had to guess I would say that it was client lists – on my computer or actual books in my closets. They never found anything because there wasn't anything to find.

It is important to note that this all transpired beginning on November 21, 2001. In late 2005, my son drowned the vehicle in a deepwater canal out by the Kennedy Space Center – an accident of course. I do hope that the tracking device went down with the vehicle. I'm also sure that another was attached to the next vehicle that I owned - long after my jury acquittal.

This was never admitted by the MBI or any other agency, but years later (2007) I heard of another situation and case in which this was done to an MBI defendant shortly after arrest. They didn't admit it in her case either, but she was positive they did it. The case is the Li Ping Ding massage parlor case and Ms. Ding ended-up pleading guilty to one count of RICO. It is Orange County, Florida case # 2007-CF-004712-A-O and for some reason, the case is currently listed as "on appeal". Ms. Ding will be on felony probation until 2019.

I am sure that illegally placing a GPS tracking device on vehicles is something the MBI did frequently - hell they were caught taping an attorney and his client in an office, so please don't pretend they're good and acted legally. The funny thing with the US criminal justice system is that it's acceptable for law enforcement to break the law, but unacceptable for a citizen to expect their constitutional rights. Does anyone care that this has been done illegally for so many years? Nope – no one cared when I complained.

Melbourne Cop Frank Carter Fired

Citizens in the predominantly Black University Boulevard area in Melbourne, Florida have something to celebrate this weekend. On August 20, 2010, the Melbourne cop that enjoyed stopping and harassing so many motorists for so many years was terminated. Carter still faces criminal charges for falsifying tickets and illegally searching vehicles, but this is one step in the right direction.


I have spoken to victims in the Melbourne area that were terrified of Frank Carter. He's one overzealous bad cop on a power trip. The great majority of his victims are Black, though I also met a Puerto Rican couple that had a couple of run-ins with him. All one must do to provoke Carter is drive past him, or be parked when he drives by.

The arrest came in late January of 2010 following a complaint by a woman that Carter had written her eight traffic tickets – her vehicle was parked on Main Street in Melbourne when the tickets were issued. He wrote her a ticket for the vehicle windows having too dark a tint – but this bad boy wrote a ticket for each window. Can you imagine? Apparently it wasn't the first time he had harassed Dienecia Johnson, but we can make a sure bet that it's the last!

Though Dienecia Johnson and most residents in this part of Melbourne consider Carter's harassment to be racially motivated, I tend to disagree. I think he is just one power hungry bad-ass cop that believes he can do whatever he wants to whoever he encounters. Most of his victims are Black, but then his patrol area is predominantly Black also. This is far from the first complaint against Carter.

Frank Carter met his match with Dienecia though! It is about time that someone removed Carter from the picture. I look forward to hearing that a trial date is set in Carter's criminal case for official misconduct and falsifying records.

All news that I have read concerning Frank Carter's arrest was in the Florida Today newspaper. Since Carter has now been terminated, I'll soon be posting information on a case in which he chased down and shot a Black male that ran through a populated apartment complex, firing his weapon over 20 times. It is an involved case, so no more hints.
